Learned advocate appearing for the Madrasah Service Commission submits that there are ten candidates senior in rank to the petitioner who are the non-joining candidates.

As the ten other non-joining candidates are senior in rank in the list of transfer counselling and the petitioner also did not get a chance to opt for Noorpur High Madrasah, accordingly, the Madrasah Service Commission is directed to allow the petitioner to participate in the transfer counselling along with other ten non-joining candidates.

In the event none of the senior candidates opt for Noorpur High Madrasah, then it will be open for the

Madrasah Service Commission to recommend the name of the petitioner in respect of Noorpur High Madrasah. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
