Ms. Chandreyi Alam, learned counsel appears for the Union of India with Ms. Runu Mukherjee, learned advocate.

The petitioner as an employee of Border Security Force (BSF) has suffered dismissal of his employment. The petitioner has preferred statutory appeal on January 8, 2024, annexure p-1 at page10 to the writ petition before the jurisdictional statutory appellate authority. The same has not yet been disposed of.

In view of the above, respondent no.2, being the appellate authority, is directed to dispose of the

appeal by passing a reasoned order strictly in accordance with law and following the procedures laid down for the same.

It is made clear that this Court has not gone into the merits of the appeal or the writ petition. The appellate authority shall be free to decide the appeal independently but strictly in accordance with law. The disposal shall be made by the appellate authority positively within a period of four weeks from the date of communication of this order. Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.

With the above observations, this writ petition, WPA 8941 of 2025 stands disposed of, without any order as to costs.
