1. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner was an employee of a third party company which acted as a correspondence agent of the bank in question. It is alleged that some money paid by the victims was not deposited to the bank. However, the petitioner was not solely responsible for the alleged transactions. The initial claim of embezzlement of Rs.90 lakhs was later reduced to Rs.15 lakhs.

2. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the statements of witnesses and copies of documents present in the case diary. He also refers to the statements of the witnesses from the third party/agent of the bank and statement of the brother of the petitioner who implicated the petitioner. Further, pursuant to a direction passed by

this Court, the statements of victims were recorded and they have also directly implicated the petitioner.

3. Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case to grant anticipatory bail to the petitioner.

4. Accordingly, the application for anticipatory bail is rejected.
