Learned advocate appearing for the petitioner submits that the petitioner is in custody for nine months, chargesheet has already been submitted and petitioner is the sole accused. It has also been contended that the genesis of the present case was on the basis of an application under Section 156(3) of the Code of Criminal Procedure being Misc. Case No. 78 of 2025 which was presented before the learned Chief Judicial Magistrate, Nadia at Krishnagar. Pursuant to the direction, the case was registered and on completion of investigation, charge-sheet has been submitted. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of

the Court to the statement of the complainant/victim under Section 164 of the Code of Criminal Procedure. I have taken into account the other materials available in the records including the statement of one Rekha Ashok Ragade. It is at the house of the said lady, the complainant and the accused resided. The said lady has been cited as a charge-sheet witness. Having considered the materials collected by the investigating agency and the information from the said lady, I am of the opinion that further detention of the present petitioner in connection with the instant case is unwarranted in the facts of the present case. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner viz., Partha Das @ Partha Ratan Das shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Chief Judicial Magistrate, Nadia, Krishnagar.

If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Trial Court and shall not leave the jurisdiction of the district of Nadia without prior permission of the learned Trial Court. The application for bail, being CRM (M) 965 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
