The grievance of the petitioner is that the petitioner was promoted to the Post of Recorder in the Basirhat Municipality whereas the employees whose names appeared below the list of the petitioner in the gradation list were promoted to the Post of Clerk.

Learned Advocate representing the Municipality submits that the petitioner accepted the Post of Recorder and has joined the said post. In reply to such submission Mr. Sarkar, learned Advocate representing the petitioner submits that he had accepted the said promotional post with objection.

Since the prayer of the petitioner for promoting him to the Post of Clerk is still pending consideration by the authorities of the Basirhat

Municipality, the writ petition being WPA 6570 of 2020 is disposed of by directing the Chairman of Basirhat Municipality to consider the representation dated June 1, 2020 and to dispose of the same by passing a reasoned order upon giving an opportunity of hearing to the petitioner or his authorized representative and communicate the same to the petitioner. The entire exercise shall be completed within a period of four weeks from the date of communication of a server copy of this order. There will be no order as to costs.
