The writ petitioner complains that since he had contested last Assembly Election as an independent candidate and had campaigned for another candidate during last Municipal Election, his house has been ransacked by the persons of the opponent and he is under serious threat of life and limb.

It is submitted that the petitioner is in fear of being assaulted by the private respondent if not killed, and hence is unable to return to his house.

Counsel for the State produces instructions of the Mogra Police Station dated 13th May, 2022 addressed to the learned State Advocate. The same is taken on record.

It is submitted that on the petitioner's complaint, 107 of the Code of Criminal Procedure proceedings have been taken out and FIR being Mogra

Police Station Case No. 152 of 2022 dated 10.05.2022 under Sections 448/504/506/379/34 of the Indian Penal Code has been registered.

It is submitted that there are criminal cases pending against the petitioner.

Since the petitioner apprehends serious threat, in returning to his house, Mogra Police Station shall arrange for the petitioner to be accompanied back to his residence. If there is any threat perception to the petitioner, Officer-in-Charge, Morga Police Station shall take all necessary steps in accordance with law. With the aforesaid observations, the instant writ petition shall stand disposed of.

There will be no order as to costs.
