AB C. O. 1362 of 2025 Jayanta Kumar Rakshit Vs Swapan Rakshit Mr. Debanik Banerjee, Mr. Akash Ganguly, Mr. Huzaifa Shahid, Ms. Poulami Das .....for the Petitioner.

This application under Article 227 of the Constitution of India is at the instance of the decree holder praying for a direction upon the learned Civil Judge (Jr. Division), 2nd Court, Uluberia, Howrah to dispose of the Title Execution Case No.02 of 2021 expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite party.

However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or upon the learned advocates representing him before the learned Executing Court. From the order-sheet appended to this revisional application, this Court finds that the Misc. Case No.19 of 2023 is pending and May 14, 2025 was fixed for hearing/evidence of the miscellaneous case.

Learned advocate appearing for the petitioner submits that July 2, 2025 has been fixed for hearing of the said miscellaneous case.

In the light of the submission made by the learned advocate for the petitioner, C. O. No.1362 of 2025 stands disposed of by requesting the learned Civil Judge (Jr. Division), 2nd Court, Uluberia to take up the hearing of the miscellaneous case no.19 of 2023 on the next date fixed i.e. 2nd July, 2025 and to make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the aforesaid miscellaneous case as well as any other applications and/or miscellaneous cases, the learned Trial Judge shall make an endeavour to dispose of the execution case expeditiously.
