Memo of evidence filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits as follows. The alleged victim owed a sum of money to the petitioner. There was an altercation and the alleged victim started shouting. The petitioner has been falsely implicated in this case. Learned Amicus assisting the State relies on the case diary and opposes the prayer for anticipatory bail. He relies on the statement of the victim and the local independent witnesses. It is the prosecution case that the petitioner allegedly assaulted the victim on his head as well as on his ear with an iron rod. The same led to serious injuries requiring stitches for repair. He also relies on the injury report. In view of the above and the other incriminating materials available in the case dairy, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
