Kausik (Allowed) CRM (NDPS) 753 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Jhargram Police Station Case No. 46 of 2025 dated February 07, 2025 under Sections 21(C)/29 of the NDPS Act.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 1 year and 2 months and the subject matter of the case relate to alleged recovery of 3.869 Kgs. of Codeine Mixture.

Learned advocate for the State opposes the prayer for bail and submits that there are antecedents of the present petitioner having 4 criminal cases.

I have taken into account the period of detention of the present petitioner as well as the quantum of seizure and the number of accused who have been involved. I have taken into

account the report which has been submitted and I find that the earlier cases are of the year 2002, 2008, 2018 and 2024. None of the cases are under the provisions of NDPS Act. Having regard to the fact that prosecution has relied upon 15 witnesses in order to prove its case, I am of the view that some time will be consumed for taking the trial to its logical conclusion.

Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Shankar Singha @ Sankar Singha @ Sankar Singh shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Additional Sessions Judge, 1st Court and Special Court under NDPS Act, Jhargram. If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Jhargram without the prior permission of the learned Special Court.

Accordingly, CRM (NDPS) 753 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
