Kausik (Allowed) CRM (NDPS) 809 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Sainthia GRPS Police Station Case No. 33 of 2025 dated October 15, 2025 under Sections 20(b)(ii)(C)/29 of the NDPS Act.

Learned advocate appearing for the petitioner submits that the subject matter of the case relate to alleged recovery of 24.3 Kgs. of Ganja, charge sheet has already been submitted and the prosecution has relied upon 13 witnesses in order to prove its case.

Learned advocate for the State opposes the prayer for bail and submits that the petitioner and the other accused persons are from Uttar Pradesh and Nagaland from whose joint possession seizure has been made.

I have taken into account the quantum of seizure, the period of detention of the present petitioner and the time which

will be consumed for the trial to be taken to its logical conclusion as 13 witnesses have been relied upon by the prosecution.

Having regard to the overall circumstances the prayer for bail is allowed.

Accordingly, Petitioner, namely, Ashish Kumar @ Ashis Kumar shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, Special Court under NDPS Act, Suri, Birbhum.

If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Birbhum without the prior permission of the learned Special Court.

Additionally, petitioner shall, once in a fortnight, meet with the Officer-in-Charge or any Officer deputed by the concerned Officer-in-Charge of Sainthia GRPS Police Station till further orders of this Court. Petitioner will also provide his mobile number to the Officer-in-Charge who will accept his attendance.

Accordingly, CRM (NDPS) 809 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
