In re:- CAN 1 of 2023 Can 1 of 2023 is an application by the writ petitioner in WPA 9993 of 2021, the said writ petition has been remanded to this Court for consideration afresh by dint of the order of the Hon'ble Division Bench dated July 18, 2023 in FMA No. 285 of 2022. Mr. Samanta, learned advocate appearing for the petitioner has submitted that copy of CAN 1 of 2023 has already been served upon the State respondent. He undertakes to file an affidavit of service on the next date of hearing. He says that according to the direction of the Hon'ble Division Bench in FMA 285 of 2022, an amended writ petition No. WPA 9993 of 2021 is required to be filed before the Court for taking up the matter for determination on merit. He has enclosed with CAN 1 of 2023, the amended writ petition. The same has also been served upon the respondent State.

Since no one is representing the State respondent today, it is directed in their absence that let this matter be listed as "Motion Group-II" immediately.

Let a notice be served upon the State respondent immediately informing the pendency of this writ petition being WPA 9993 of 2021 in this Court, on record. (Rai Chattopadhyay, J.)
