It appears to the Court that the cause of action in the writ petition does not survive in view of the fact that the company, who is the petitioner before this Court, is in liquidation. On the basis of the proceedings before the learned National Company Law Tribunal, forensic audit is still going on with regard to the accounts and assets. The liquidation process expired on July 5, 2022 and the liquidator has sought for approval for extension of the liquidation period in order to complete the pending process and awaiting disposal of the proceeding before the learned National Company Law Tribunal.
A copy of the instructions of the liquidator addressed to the learned Advocate-on-record is taken on record. Thus, the writ petition is disposed of without further orders and upon recording the above facts.
This order shall not have any impact on any other proceedings.
There will be no order as to costs.
All parties are to act on the basis of the server copy of this order.
