The writ application has been preferred praying for direction upon the respondent no. 1, the EPF authorities to ensure release of the petitioner's legal and rightful Provident Fund accumulations and interests thereupon Provident Fund pension in terms of 1952 and Scheme framed the Act, thereunder upon deposition of due contributions from balance month of May, 2015 till his retirement on January 31, 2024, and direction upon the learned Labour Court to dispose off Case No. Comp22/2024 under Section 33C (2) of the Act, 1947, pending before it within specified time-frame. On hearing the learned counsels for the parties and considering the materials on record, the writ application is disposed of with the direction that the respondent no. 1/ PF authorities shall consider the prayer of the petitioner in accordance

with law and dispose of the same by passing a reasoned order preferably within 60 days from the date of communication of this order.

It is further directed that as admittedly suspension allowance was being paid to the petitioner herein by the company. The related dues, if any, are pending adjudication before the Labour Court in Computation Case No. 22 of 2024 under Section 33C (2) of the Act, 1947.

The Labour Court shall make all endeavour to dispose of the case in accordance with law by passing a reasoned order preferably within 3 months from the date of communication of this order.

The writ application stands disposed of.

Applications, if any, connected thereto stand disposed of consequently.

Interim order, if any, stands vacated.

Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
