For the State The petitioner has filed the instant application for bail under Section 439 of the Code of Criminal Procedure in connection with Bongaon Police Station Case No. 771 of 2019 under Section 21(C) of the NDPS Act. Indubitably, commercial quantity of contraband, i.e., 4.9 litres of codeine phosphate mixture was recovered from the possession of the petitioner. The earlier two applications for bail were rejected by this Court. We do not find any changed circumstances warranting the different decisions to be taken.

The application for bail is, thus, considered and rejected. The trial Court is requested to expedite the trial of the case. (Harish Tandon, J) (Bibek Chaudhuri,J.)
