Kundu ....for the petitioner Mr. Chandi Charan De Mr. Anirban Sarkar ...for the State The petitioners complain that a portion of their land has been utilised by the Special Land Acquisition Officer, Uttar Dinajpur, Raiganj for Teesta Barrage Project though the said land was not acquired by the authorities. Petitioners have filed an application before the Special Land Acquisition Officer, Uttar Dinajpur, Raiganj, the respondent no. 5 herein on 12.03.2020 disclosing their grievances. The said application has not been considered till date.

Having considered the submission made by the learned counsels appearing on behalf of the parties and the material on record, I dispose of this writ petition with a direction upon the respondent no. 5 to dispose of the application of the petitioners submitted before him on 12.03.2020 after giving opportunity of hearing to all the affected parties including the petitioners, within a period of

three (3) months from the date of communication of this order, in accordance with law.

The petitioners shall be at liberty to produce all relevant documents before the respondent no. 5 at the time of hearing.

With the above observations and directions this writ petition being WPA No. 10004 of 2021 is disposed of. There shall be, however, no order as to costs. Since no affidavit in opposition is invited, the allegations contained in the petition are deemed not to be admitted.
