Wife of the petitioner was an employee of Kharagpur Municipality.

She died-in-harness on December 15, 2012. The husband alleges that after her death only family pension has been released in favour of the heirs of the deceased.

The petitioner claims that he is entitled to other terminal benefits. A representation was filed by the petitioner before the Municipality in March 2020 seeking release of the death gratuity. The same is yet to be disposed of.

On a perusal of the representation filed by the petitioner it appears that the details of the amount claimed to be due is not mentioned.

It will be open for the petitioner to file appropriate representation before the Municipality seeking release of the dues.

In the event, such a representation is filed, the Kharagpur Municipality is directed to take steps to consider the same in accordance with law and to

intimate the petitioner the formalities required to be complied for disbursing the dues, if any.

Steps shall be taken in the matter at the earliest but positively within a period of eight weeks from the date of receipt of the representation from the petitioner. The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
