Mr. Soumya Majumder, Mr. Victor Chatterjee, Mr. Barnamoy Basak, Mr. Ranit Ray ... For the respondent no. 4 Mr. Mukherjee, appearing in support of the aforesaid application submits that the Central Government Industrial Tribunal (in short, CGIT), Kolkata, had not been functioning more than two years and for reason aforesaid the present writ application had been filed before this Hon'ble Court. He further submits that CGIT, Kolkata, is now functioning. In view of the recent development, he seeks leave to withdraw the aforesaid application and to proceed in the pending reference on the selfsame cause of action. Drawing my attention to the order dated 20th December, 2019 passed by this Hon'ble Court he submits that despite directions passed by this Hon'ble Court, the matter has been kept pending. The aforesaid reference, being No.11 of 2018 is still pending.

Mr. Majumder, appears for the respondent no.4. Heard the learned advocates appearing for the respective parties. In view of the submission made by Mr. Mukherjee, leave is granted to Mr. Mukherjee to withdraw the aforesaid application. However, considering the fact that the reference case is pending since 2018 and by an order dated 20th December, 2019, this Hon'ble Court in WP 3363(W) of 2019 directed the reference Case No.11 of 2018 to be disposed of positively within six months from the date of communication of such order, I direct that CGIT, Kolkata, should adhere to the direction passed by this Hon'ble Court on 20th December, 2019.

In view of the aforesaid, nothing survives in the writ application, being WPA 8563 of 2022, which stands disposed of without any order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of necessary formalities.
