Mr. Santanu Chatterjee ..for the State Learned advocate for the petitioner submits that the petitioner has been falsely implicated in the case as his brother is principal accused. Learned advocate further submits that there are no materials available against the present petitioner except the relationship and as such the custodial detention of the present petitioner is unwarranted.

Mr. Mukherjee, learned advocate for the State opposes the prayer for bail and submits that although the other accused being his brother fired at the victim yet the present petitioner caught hold of the victim at the time of fire.

Having considered the materials appearing against the present petitioner, we are not inclined to extend the benefit of anticipatory bail.

Accordingly, prayer for anticipatory bail is rejected. With these observations, CRM 6001 of 2020 and CRAN 1 of 2020 (Old No. CRAN 4451 of 2020) are disposed of. (Samapti Chatterjee, J.) (Tirthankar Ghosh, J.)
