Mr. Sandip Chakraborty Ms. Srilekha Chatterjee ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. The victim was a hooligan who used to create trouble after getting drunk. On the day of Holi he was doing so. He had an altercation with the petitioner, his brother and the other villagers. He fell down and received injuries. Learned counsel appearing on behalf of the State relies on the case diary and opposes the prayer for anticipatory bail. He refers to statements of independent eyewitnesses, statements recorded before the learned Magistrate as well as post mortem report. The post mortem report stated that the victim died due to head injury. Eye witnesses stated that the petitioner had inflicted the blows on head and other parts of the body. Considering the incriminating materials available in the case diary against the present petitioner, I do not think that this is a fit case for granting anticipatory bail.
Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
