For the State The petitioners are directed to serve a copy of this revisional application upon Ms. Manisha Sharma, Learned Advocate, who ordinarily appears on behalf of the State. Her appearance may be regularised by the concerned authority. I find from the records of the case that the petitioner has challenged the continuation of B.G.R. Case No. 5720 of 2014 arising out of Basanti P.S. Case No. 525 dated 21.11.2014. The records of the case speak that the evidence has already commenced. The petitioner earlier approached this Court in CRR 3373 of 2022, where there was a direction by a Co-ordinate Bench of this Court to conclude the trial at the earliest. In spite of the same, I find that the case is progressing very slowly.

Having considered the facts of the case, I am not inclined to interfere in the matter, at this belated stage i.e. after nine years.

Consequently, I direct the Learned Trial Court to fix at least one date in a month for the purposes of the present case, so that the direction of the Co-ordinate Bench in CRR 3373 of 2022 may be complied with.

The Superintendent of Police, Baruipur Police District would take steps so that the witnesses are available on the next date so fixed.

The Learned J.M., in seisin, of the matter, would communicate with the Superintendent of Police, Baruipur, who would make arrangements for ensuring the presence of the witnesses on the date so fixed for evidence. All efforts be taken so that the within a year from date the evidence of the prosecution is completed.

With the aforesaid observations, CRR 1367 of 2023 is disposed of Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
