CRAN 1 of 2020 (Old CRAN 4464 of 2020) (via video conference) In Re : An application for anticipatory bail under section 438 of the Code of Criminal Procedure in connection with Jalangi P.S Case no. 221 of 2020 dated 02.06.2020 under sections 21 (C)/29 of the N.D.P.S. Act.

The petitioner undertakes to affirm and stamp the petition as per the Rules within a month of resumption of normal functioning of the court. The petition is taken up through video conference on the basis of such undertaking. Accordingly, the application being CRAN 1 of 2020 (Old CRAN 4464 of 2020) is disposed of.

Learned Counsel appearing on behalf of the State has submitted that a co-accused, namely Rajiv Doctor @ Ripon @ Rajib Daktar & Anr. is similarly placed that of the present petitioner, had applied for anticipatory bail before a Coordinate Bench and the prayer for bail was rejected by the Coordinate Bench on 27th July 2020.

Having considered the materials on record and prima facie disclosing involvement of the petitioner in dealing in

narcotic substance above commercial quantity, we are of the opinion that this is not a fit case to grant anticipatory bail. Accordingly, the prayer for bail is rejected. CRM 6012 of 2020 is disposed of.
