APP Mr. Utsav Dutta ... for the State-respondent(s) The petitioner is in custody for more than 11 months and the subject-matter of the case relate to alleged recovery of 99 kg of ganja from the roof of a Bus. The petitioner was arrested pursuant to the statement of the conductor and the driver of the said Bus.
The accusation against the present petitioner is that he happens to be the manager of the godown. It has been informed that similarly placed accused person has been granted bail in CRM (NDPS) 213 of 2026. However, there was a direction for releasing the petitioner on bail after the stage of consideration of charges is over. It has again been informed that charges have already been framed before the learned Special Court.
In view of the petitioner and Dilip Kumar Samanta being on the same footing, if the learned trial court has already granted bail to Dilip Kumar Samanta pursuant to the direction of this court, the present petitioner be extended the same benefit on the same terms and conditions on which the said accused [Dilip Kumar Samanta] was granted bail in terms of CRM (NDPS) 213 of 2026.
Hence, the prayer for bail of the petitioner being Madan Saha is Allowed.
Accordingly, CRM (NDPS) 757 of 2026 is allowed. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
