Over the said issue proceedings are pending before the learned Civil Judge (Jr. Divn.), Kakdwip as is reflected from the order passed by the Revenue Officer.

State has submitted a report which reflects that the petitioner and the private respondents appeared before the different forum including the Executive Magistrate but the police authorities have their own finding so far as the enquiry is

concerned.

However, the police authorities find that no construction has been made at the site and a proceeding under Section 126 of the BNSS has been drawn.

Considering the same, I am of the view that so far as the right, title, interest, usages and occupation of the property is concerned, the police authorities will not interfere with the same but the police authorities would oversee and continue their surveillance so that no untoward incident results because of the strained relationship existing between the parties.

With the aforesaid observations, WPA 8847 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. Copies of the report be handed over to both the parties.
