Petitioner participated in 12th Regional Level Selection Test, 2011 and was belatedly appointed in terms of the order dated 22nd August, 2022 passed in the writ petition being WPA 9368 of 2022 (Surajit Goswami v. The State of West Bengal & Ors.). Appointment letter was issued by the Board on 6th February, 2023 and petitioner joined the school on 9th February, 2023.

By presenting the writ petition petitioner has laid a claim to grant notional benefits in his favour from 2014 since in 2014 first writ petition was filed.

In this regard, reliance is placed on memo

dated 8th December, 2023 issued by the District Inspector of Schools (SE), Bankura addressed to the Commissioner of School Education, West Bengal.

State respondents and West Bengal Central School Service Commission are represented by learned advocates.

Considering the case made out in the writ petition and taking note of the memo dated 8th December, 2023 issued by the District Inspector of Schools (SE), Bankura present writ petition is disposed of directing the Commissioner of School Education, West Bengal to take decision on the claim of the petitioner by twelve weeks from the date of communication of this order.

Before taking such decision opportunity of hearing shall be given to the petitioner or his representative and a reasoned order shall be passed which shall be communicated to the petitioner by fortnight thereafter.

Leave is granted to the petitioner to amend the cause title in course of this day and add Commissioner of School Education as additional respondent.

However, service of notice upon the additional respondent stands dispensed with since

State respondents are represented by learned advocates.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
