21.02.2022 Sl. No. 5 Court No.35 BM (Via Video Conference) C.R.R. 1364 of 2011 Sri Prabir Roy Vs.

Dipika Roy & Anr.

The matter is listed today for second consecutive day for filing affidavit of service and hearing. None appears for the petitioner. The revisional application was preferred under Sections 401/482 of the Code of Criminal Procedure, praying for setting aside of order dated 7.4.2011 passed in G.R No.575 of 2004 under Sections 498A/323/34 of the Indian Penal Code pending before the learned Additional Chief Judicial Magistrate, Durgapur. On 29.4.2011 an interim order was passed staying further proceeding of the case for a period of two months from the date of order. No extension order was passed thereafter. It is not known if the case has been disposed of in the mean time. This application has become infructuous now. The revisional application is therefore dismissed for default of the petitioner. Connected application, if any, are also dismissed for default.

Let a copy of this order be sent to the learned Additional Chief Judicial Magistrate, Durgapur for information. (Ananda Kumar Mukherjee, J.)
