The father of the petitioner was an employee of Bally Municipality. He died-in-harness on June 13, 2015. The mother of the petitioner i.e. the widow of the employee filed an application for providing compassionate appointment in favour of her son i.e. the petitioner herein on January 9, 2017. The same is yet to be considered by the respondents. Further application was made by the widow in March 2022 and by the petitioner in April/May 2022.

Learned advocate representing the Municipality is yet to receive instruction in the matter. The petitioner prays for a direction upon the Municipality for consideration of the application for compassionate appointment.

As it appears that the application for providing appointment on compassionate ground is pending

consideration at the end of the Municipality for quite some time, accordingly, the Bally Municipality is directed to consider the application of the petitioner in accordance with law, at the earliest, but positively within a period of eight weeks from the date of communication of a copy of this order.

The aforesaid respondent shall pass a reasoned order and communicate the same to the petitioner immediately thereafter.

Instruction given by the Director of Local Bodies be retained with the records.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
