-vs- Gobardanga Municipality & Ors.

17.07.2023 Ct.15 Mr. Gopal Chandra Ghosh ... for the petitioners. Mr. Avishek Prasad ... for the State. The writ petition is taken up for consideration in presence of the learned advocates representing the petitioners and State respondents including Block Land and Land Reforms Officer, Habra-I, District- North 24 Parganas. However, no one is representing Gobardanga Municipality today. After hearing Mr. Ghosh, learned advocate, representing the petitioners it appears that the writ petition was instituted on apprehension that the land of the petitioners may be acquired by Gobardanga Municipality in view of the fact that a placard has been fixed on the land of the petitioners declaring that the land is under municipality.

However, today on behalf of petitioners it has been candidly submitted before this Court that subsequently placard has been removed and petitioners are in possession of the land in question.

In view of aforesaid submission made on behalf of petitioners it appears that grievance of the petitioners has been redressed.

Accordingly, the writ petition stands

disposed of.

However, this order shall not preclude the petitioners to take steps in accordance with law if in future steps are taken by the authority relating to the land in question.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
