The grievance of the petitioner is directed against unauthorised encroachment of a public land by the private respondent nos. 6 to 9.

It is submitted on behalf of the petitioner that the private respondents have caused constructions of a pucca structure and thereby caused obstructions with the ingress and egress of the petitioner's land without authority of law.

Mr. Sengupta appears on behalf of the State respondents and submits that he has no objection if the Assistant Engineer, Jaynagar Sub-Division, PWD, Dakshin Bishnupur being the respondent no.4 herein be directed to cause an enquiry into the grievance of the petitioner.

Accordingly, I direct the respondent no.4 to cause an enquiry into the allegation made by the petitioner in accordance with law after giving an right of haring to all the affected parties including the private respondents. Such exercise is to be completed by the respondent no.4

within a period of eight weeks from the date of communication of this order.

It is made clear that I have not gone into the merits of the case and all questions in respect of the grievance of the petitioners are left open to be decided by the respondent no.4 in accordance with law.

With the aforesaid directions, WPA 10027 of 2021 is disposed off.
