IN THE HIGH COURT AT CALCUTTA

Criminal Revisional Jurisdiction 15-06-2022 Subha Item no.23 Ct no.34 CRR 1613 of 2022 In the matter of : Md. Amirul Sk. & Anr. .....petitioners. In Re : An application under Section 482 of the Code of Criminal Procedure.

Mr. Debapratim Guha Mr. Diptendu Banerjee Ms. Pinki Sarkar Mr. Sandip Dinda ......for the petitioners.

Mr. Arijit Ganguly Ms. Debjani Sahu ....for the State.

Report submitted by the Officer-in Charge, STF Police Station, Kolkata Police dated 14.06.2022 be kept with the record. The report reflects that application for cancellation of bail in respect of the four accused in connection with STF Police Station Case No. 13 of 2020 is pending.

It has been submitted on instruction by Mr. Arijit Ganguly, learned advocate appearing for the State that the application for cancellation of bail is pending before the Division Bench and could not be heard in time in spite of the efforts of the prosecution. As the prayer of the Investigating Agency in respect of cancellation of bail is still pending and the accused persons including the present petitioners are on interim bail and the same bail has not been affirmed by the trial court, I am not a position to give a direction

for expediting the trial of the case.

Mr. Guha, learned advocate appearing for the petitioners today at the inception submitted that he do not intend to proceed with the revisional application. Such submission of the learned advocate appearing on behalf of the petitioner is of substantially no use when an affirmed application has been preferred before this court. With the aforesaid observations, the revisional application being CRR 1613 of 2022 is disposed of.

All pending applications, if any, in connection with the revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.

All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
