Mr. Suman Dey ... For the School The school has filed a report and has sincerely set out all reasons as why proceeding with the petitioner's application would cause severe hindrance to the functioning of the school.

This Court does not wish to enter into such grounds in detail. Since the petitioner has applied for transfer on medical ground, upon receipt of such application the head of the institution shall refer the petitioner's case to the BHOM and take steps strictly in terms of 2015 Rules. For the aforesaid purpose, the petitioner shall apply afresh for her transfer on medical grounds, in terms of the 2015 Rules and the respondents shall process with the said application in accordance with law.

The Court notices a serious dearth of teachers in the school in question, i.e., Sree Sarada Ramkrishna Balika

Bidyaptih. The respondents, i.e., the Commissioner of School Education, the District Inspector of Schools (S.E.) and the School Service Commission shall, in consultation with the said school, take immediate steps under the available laws for posting of considerable number of teachers in the said school.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.
