Petitioner prays for default bail.

Learned Advocate appearing for the petitioner submits that the petitioner was taken into custody on September 29, 2021 and produced before the jurisdictional Court on September 30, 2021. The Charge sheet is claimed to be submitted on March 25, 2022. In fact, it was not so. He refers to the order sheet in this regard.

Learned Advocate appearing for the State submits that the charge sheet was submitted on March 25, 2022 well within the statutory period of 180 days.

The orders dated March 28, 2022/ April 4, 2022 of the jurisdictional Court states that charge sheet dated March 25, 2022 was received. Cognizance was taken.

Such orders are not under challenge at the behest of the petitioner. Therefore, there are no material on record as on date that there was default on the part of the police in submitting the charge sheet within the statutory period. Consequently, we are unable to enlarge the petitioner on default bail. Accordingly, the prayer for bail of the petitioner is rejected.

C.R.M. (NDPS) 471 of 2022 is dismissed.
