The subject matter of challenge is an order dated 30th July, whereby the writ petitioner/respondent in the instant appeal had challenged the appointment of the appellant as an Assistant Engineer.

It was the contention of the writ petitioner that the appellant has been appointed contrary to the due process of law and without any proper recruitment process being undertaken.

The learned Single Judge of this Court has only directed the respondent no.1 being the Principal Secretary, Department of Urban Development and Municipal Affairs to look into the circumstances under which the appellant was appointed in Raghunathpur Municipality within a period of twelve weeks from the date of the impugned order and the appellant was directed to be heard as well.

This Court sees no reason to interfere with the impugned order dated 30th July, 2020 as it merely

directs consideration of the representation and a decision by the Secretary of the Municipal Affairs Department of the State.

Given the lapse of time, the respondent no.1 is expected to have disposed of the representation in terms of the order of the learned Single Judge of this Court impugned herein.

With the aforesaid directions, M.A.T. No. 520 of 2020 shall stand disposed of without any order. 7.

In view of dismissal of the appeal itself, all the pending connected applications are dismissed. 8.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
