Counsel for the petitioner submits that notwithstanding undertaking before this Court Ld. Counsel of the State did not allow the petitioner to go through the statements of the witnesses under Section 161 of the Cr. P. C. since charge sheet has put for committal.

The Court below may take steps under Sections 311 and 319 of the Cr. P. C. if deemed necessary to identify the real accused and the truth.

The petitioner may be allowed to go through the statements of the witnesses in the matter by the court below.

The report of the Duttapukur Police Station dated 16.01.2023 addressed to State advocate, has been produced by an office of the police and the same is taken on record.

The writ petition is disposed of.

There will be no order as to costs.
