The application being CAN 1 of 2020 (Old No.

CAN 5439 of 2020) is disposed of.

It is the contention of the petitioner that the vehicle which was hypothecated to Bank of Baroda, Barasat Branch was forcefully snatched away from the custody of the driver of the petitioner on NH 34, despite there being a moratorium declared by the Reserve Bank of India.

It is submitted that a complaint was lodged with the Chakdah Police Station, Nadia, West Bengal but no action has been taken in the meantime.

This writ petition is disposed of with a liberty to the petitioner to approach the Superintendent of Police, Nadia with his grievances and the Superintendent of Police, Nadia shall consider and dispose of the

grievances of the petitioner in accordance with law. The said authority shall independently decide the issues involved and direct investigation, if required as per law. The authority shall also afford an opportunity to the respondents to put forward their version.

The entire exercise shall be completed within a period of eight weeks from the date of communication of this order.

It is also made clear that the police authorities may guide the petitioner with regard to the steps that he may take in the matter. However, the authorities shall act independently without being influenced by this order.

This court has not decided on the merits of the claim of the petitioner.

The writ petition stands disposed of.

There will be, however, no order as to costs. Urgent photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
