Learned counsel for the petitioner submits that the construction raised by the private respondent is an illegal construction. However, there is no prima facie material filed alongwith the petition to support the said contention. It is submitted that the petitioner preferred an application for obtaining information under the Right to Information Act, 2005 but no such information is

provided by the authority. The petitioner needs to at least prima facie show that construction is illegal in nature. In absence thereof, the Court cannot conduct a roving enquiry in a matter of this nature.

This petition is not entertained but liberty is reserved to the petitioner to file a properly constituted petition alongwith documentary evidence.

The petition is, thus, dismissed.
