Petitioner(s) Mr. Kaushik Chowdhury Mr. Dwaipayan Panda ... for the Petitioner(s) Mr. Antariksha Basu Mr. Dattatreya Dutta ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner has been arrested in connection with the instant case only on the basis of statement of a co-accused and is in custody for about 70 days. Learned advocate also submits that the petitioner is similarly placed as the other accused person who has been granted bail in CRM (NDPS) 1108 of 2025.

Learned advocate for the State, on the other hand, opposes the prayer for bail on the grounds that the petitioner has similar antecedents.

Be that as it may, having regard to the materials appearing against the present petitioner and the present case which is based only on the statement of the co-

accused, I am of the view that the petitioner may be extended the same benefit as enjoyed by the other accused person who has been granted bail in CRM (NDPS) 1108 of 2025.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Saleem @ Salim Mia @ Selim Miya shall be released on bail on the same terms and conditions as was imposed in CRM (NDPS) 1108 of 2025.

Accordingly, CRM (NDPS) 759 of 2026 is allowed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
