Petitioner is aggrieved by the fact that the private respondents who happen to be the daughter and son-inlaw along with their associates are attempting to oust the petitioner from the residence. Information was sent to the police authorities and petitioner has already approached the Sub-Divisional Executive Magistrate.

Learned advocate appearing for the petitioner submits that the petitioner approached Sub-Divisional Officer under the relevant provisions of Maintenance and Welfare of Parents and Senior Citizens Act, 2007 but the same has been refused. Petitioner submits that he intended to prefer an appeal against the said order. Learned advocate for the private respondents denies and disputes the contentions advanced on behalf of the petitioner.

State has submitted a report. Report reflects that because of the dispute and differences already Murutia PS Case no. 152/24 dated 19.05.2024 has been registered for investigation and subsequently, chargesheet has also been submitted before the jurisdictional Court.

Be that as it may, police authorities are in knowhow and in seisin of the issue regarding the family feud, as such they would keep a surveillance so that the petitioner and his wife is not thrown out of the house and ensure that no untoward incident results because of the strained relationship existing between the parties. With the aforesaid observations WPA 9076 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to the learned advocate appearing for the petitioner.
