Let the affidavit of service filed in Court today be taken on record.
By way of this writ petition, the petitioners complain of an inaction on the part of the respondent nos. 1 to 12 in not initiating proceeding under in the Inland Fisheries Act, 1984.
According to the petitioners, the respondent no.13 has been filling up a pond which is an offence under the said Act.
Records reveal that several complaints have been lodged before the authorities concerned including the Block Land and Land Reforms Officer, BlockCanning -I. Mr.
Bandopadhyay, learned advocate
appearing for the State respondents submits that Block Land and Land Reforms Officer, Block-Canning-I, pursuant to the complaints of the petitioners has directed both the parties to appear before him on September 18, 2020 for a hearing and also directed the respondent no.13 not to fill up the pond.
As the Block Land and Land Reforms Officer, Block-Canning-I has already directed the parties to appear before him for a hearing, this writ petition is disposed of with a direction upon the Block Land and Land Reforms Officer, Block-Canning-I to complete the hearing upon giving an opportunity to both the parties within two weeks. Upon completion of the hearing, if the Block Land and Land Reforms Officer, BlockCanning-I is satisfied that the respondent no.13 has made any offence, as alleged by the petitioners under the West Bengal under the Inland Fisheries Act, 1984, he shall take appropriate steps in accordance with law. This writ petition is disposed of.
There will, however, be no order as to costs. Parties are directed to act on the learned Advocate's communication.
