Mr. Tauhid Khan Mr. Monirul Islam Mollah ...For the petitioners Ms. Amrita Pandey Mr. Ghanshyam Pandey Mr. Sneha Singh ...For the respondent nos. 4 Ms. Pandey, learned advocate representing the respondent no. 4 places before this Court, two separate undertakings executed by Jayanta Hajra and Subrata Kumar Naskar, both being the Directors of the repondent no. 4.

Ms. Pandey submits that since there is no post of Managing Director at present in the respondent no. 4/company, the aforesaid undertaking which was directed to be furnished by the Managing Director, has been furnished by the other two directors of the company. In view thereof, let the order dated 10th May 2023 be modified by permitting Jayanta Hajra and Subrata Kumar Naskar, both being the directors of respondent no. 4 to file undertakings in the manner as directed in the order dated 10th May 2023.

The aforesaid undertakings filed by Jayanta Hajra and Subrata Kumar Naskar are taken on record. The respondent no.4 and the aforesaid two Directors are directed to comply with all other terms of the order dated 10th May, 2023.

Since, nothing survives in the present writ application, the same is accordingly disposed of. Court fees paid are found to be sufficient.

There shall be no order as to costs.

Urgent photostat certified copy of this order if applied for be given to the parties upon compliance of requisite formalities.
