Petitioner is aggrieved by the fact that the petitioners are resisted from raising their construction in spite of being in possession of all relevant documents. To that effect they have specific accusations against the administration and the private respondents.

Learned advocate for the private respondents, on the other hand submits that the petitioners do not have any sanctioned plan.

Mr. Ahmed, appears on behalf of the State and submits that till date the State has not been

informed in respect of the inconveniences faced by the petitioners. Since the petitioner was not properly advised at the relevant stage and as such approached the Executive Magistrate, I direct that if any inconveniences are faced, petitioner will file a representation with the police authorities of Beldanga Police Station, Murshidabad.

The concerned police station on receipt of the same will consider the nature of dispute and thereafter take steps in accordance with law. Needless to state that if there is a civil dispute, police authorities will not interfere with the same, but would only ensure that there is no breach of the peace and/or tranquility and/or any untoward incident not resulting because of the strained relationship between the petitioners and the private respondents.

With the aforesaid observations WPA 9709 of 2024 is disposed of.
