The petitioners are aggrieved by the manner of progress in the trial of G.R. Case No. 84 of 2023 (arising out of Pandua P.S. Case No. 19 dated 7.1.2023).
Ld. Advocate for the State submits that already, after completion of investigation, charge-sheet has been submitted and charges have already been framed. According to the ld. Advocate for the State, the prosecution has relied upon five witnesses to prove its case and all efforts are being taken to conclude the trial at the earliest.
The grievances of the petitioners is that on 12.2.2024, the ld. Magistrate fixed a date on 7.2.25, i.e., after a year.
Having regard to the manner in which date has been fixed by the ld. Trial court, I direct that on and from 7.2.2024, the ld. Magistrate would fix one date in every 75
days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. The summons so issued, in case, is not responded to, should be executed through the inspector in charge of Pandua P.S., who would engage a police personnel for effecting service and ensure regarding the availability of the witnesses on the date so fixed by the ld. Trial court.
It is further directed that the trial of the present case would continue in spite of any resolution of the local Bar and the participating advocates will not stall the proceedings because of such resolution. All stakeholders will cooperate with the ld. Trial court for concluding the trial at the earliest. With the aforesaid observations, CRR 1453 of 2024 is disposed of.
Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
