1. The petitioner has filed the present writ application praying for a direction upon the respondent authorities for extension for engagement of the petitioner to supply the food stuff (rice, musur dal, mustered oil and iodized salt) to the Domkul, Jalangi and Samserganj ICDS Projects in the District of Murshidabad.

2. Learned counsel appearing for the petitioner submits that since the year 2014, the petitioner is supplying food items to the Angaganwadi Centres. He submits that the agreement was expired in the month of March, 2026 but in advance the petitioner has made prayer before the authority for extension of the agreement for supply the food materials but till date the authorities

have not considered the request of the petitioner and the same is pending before the authority.

Learned counsel for the petitioner further submits that on earlier occasion also the respondent authorities failed to consider the representation filed by the petitioner for extension of agreement for supply of food items to the Anganwadi Centres. This Court by an order dated November, 14, 2024 in WPA 27069 of 2024 directed the authorities for consideration of the case for passing the appropriate order. In terms of the said order, the authorities have issued the order for extending the contract period of the petitioner. He submits that the petitioner prayed for similar order in the present writ application.

Per contra, learned counsel for the State submits that the contract period of the petitioner has expired in the month of March, 2026 and subsequently the interim arrangement has been made by allowing other three persons to supply the articles to Domkul, Jalangi and Samserganj ICDS Projects due to the Model Code of Conduct in connection with the ensuing General Assembly Election, 2026. He further submits that on February 26, 2026 the petitioner has submitted a representation stating that due to unforeseen financial circumstances, the petitioner regret to continue to supply the materials in the said project and

accordingly the authorities have issued the work order to other three persons for supply of the materials.

5. Learned counsel for the petitioner submits that the petitioner has submitted his unwillingness as the authorities have not released the payment of the petitioner. Now the authorities have released the payment and the petitioner has withdrawn the said application and he is ready to supply the materials to the ICDS project.

6. Heard the learned counsel for the respective parties and considered the materials on record. This Court finds that the contract period of the petitioner is completed and the petitioner has given an unwillingness to continue the project work and the authorities have already issued the work order to some other persons till the month of May, 2026. Thus, no order can be passed in the present application. It is up to the authorities to take appropriate steps in accordance with law.

7. Accordingly, WPA 9494 of 2026 is dismissed.
