Petitioner is in custody for 1 year and 10 months. Alleged recovery in this case is of 516 Kgs. of Ganja. Charge was framed in May, 2025.

Learned advocate submits that there has been no progress of the trial after consideration of charges and earlier there was a direction for expeditious trial.

Learned advocate for the State submits, on the other hand, that after the charges were framed, it was detected that another accused was absconding. As such, process was issued for tracing out the absconding accused. Till date, no report has been submitted so far as the execution of the warrant of arrest is concerned, as such, the trial could not proceed.

Having considered the same, I direct the Investigating Officer to submit a proper report on the next date fixed, either a report for execution of the warrant of arrest or non-execution report in respect of the warrant of arrest. The harsher process of law be completed within the next 75 days and thereafter date be fixed for examination of the witnesses.

Petitioner would be at liberty to approach this Court after the evidence of the seizure list witnesses are over. Learned Trial Court, after the said period of 75 days, would fix date for examination of the seizure list witnesses. With the aforesaid observations CRM (NDPS) 763 of 2026 is dismissed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
