Kausik (Allowed) CRM (NDPS) 764 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Sealdah GRPS Police Station Case No. 114 of 2025 dated 24.11.2025 under section 20(b)(ii)(c)/29 of the NDPS Act, 1985. Learned advocate appearing for the petitioners submits that petitioners are in custody for more than 5 months and charge sheet has already been submitted. So far as the case of the prosecution is concerned, allegedly there has been recovery of 28.791 Kgs. of Ganja. Prosecution has relied upon 12 witnesses in order to prove its case. As such, the investigation being concluded, petitioners may be released on bail. Learned advocate for the State opposes the prayer for bail.

I have taken into account the quantity of recovery, the time which may be taken for taking the trial to its logical

conclusion as 12 witnesses have been relied upon and till date charges have not been framed.

Having considered the same, I am inclined to release the petitioners on bail.

Accordingly, Petitioners, namely, (1) Sagar Miah, (2) Ripan Mia @ Ripan Miah shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Additional District and Sessions Judge, 12th Court cum Special Court under NDPS Act, Alipore.

If on bail, petitioners shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of Kolkata Municipal Corporation without the prior permission of the learned Special Court. Additionally, petitioner shall meet with the Officer-in-Charge or any Officer deputed by him of Sealdah GRPS Police Station till the same is waived by the learned Trial Court.

With the aforesaid observations CRM (NDPS) 764 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
