Petitioner was appointed as Group -D staff in Birpur High School, Nadia (hereinafter referred to as "said school") on 15th November, 2007. After appointment of the petitioner as Group -D staff in said school District Inspector of Schools (SE), Nadia vide memo dated 1st January, 2008 granted approval of appointment subject to outcome of a pending writ petition being WPA 10968 of 2007 [Sukla Biswas (Haldar) Vs. The State of West Bengal & Ors.]. Said writ petition being WPA 10968 of 2007 was dismissed by a Coordinate Bench vide order dated 6th December, 2023. Therefore, prayer is made on behalf of the petitioner in the present writ petition for issuance of final approval of
appointment in connection with his appointment as Group -D staff in said school with effect from 15th November, 2007.
Nothing is forthcoming today from where it can be found that legal steps have been taken questioning the order dated 6th December, 2023 passed by the Coordinate Bench on WPA 10968 of 2007. Therefore, this Court finds no impediment in directing the District Inspector of Schools (SE), Nadia being respondent no. 4 to take steps accordingly.
Hence, writ petition stands disposed of directing respondent no. 4 to issue final approval of appointment in favour of the petitioner by four weeks from date of communication of this order in view of dismissal of writ petition being WPA 10968 of 2007 by order dated 6th December, 2023.
Communication dated 25th April, 2025 of the District Inspector of Schools (SE), Nadia is taken on record.
