(DB) No. 1519 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Palashipara Police Station Case No. 248 of 2020 dated 08.09.2020 under Sections 447/326A/307//34 of the Indian Penal Code adding Section 302 of the Indian Penal Code.

And In Re : Jamu Sk. ..... petitioner Mr. Asraf Mandal ... for the petitioner Mr. Neguive Ahmed, learned APP Ms. Ayantika Ray ... for the State Learned Counsel for the petitioner submits he is in custody for more than two years. It is also submitted he is not the principal accused. He prays for bail.

Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record including the statement of the victim lady who subsequently succumbed to her injuries. She has implicated the petitioner as one of the persons who had thrown acid on her face. Co-accused who has been enlarged on bail was not named by the victim. In view of the involvement of the petitioner in the crime, as trial is in progress and charge has already been framed, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

Trial court is requested to expedite the trial and examine the witnesses at the earliest.
