Learned Advocate for the petitioner prayed for transfer of the case from the Court of learned Chief Judicial Magistrate, Burdwan to the Court of learned Chief Judicial Magistrate, Sreerampore, Hooghly.

Petitioner is the husband against whom Misc Ex. No. 128 of 2017, along with Misc Ex. No. 368 of 2019, Misc Ex. No. 92 of 2020 and Misc. Ex. No. 167 of 2021 are pending.

Having regard to the fact that in a proceeding under Section 125 of Code of Criminal Procedure four execution cases are pending against the present petitioner, I am not inclined to accept the reasons which have been prayed for in the present application. No interference is made at this stage.

Petitioner would be at liberty to approach this Court at the appropriate stage after clearing all the arrears and dues in this proceeding pending before the learned Court at Burdwan. With the aforesaid observations CRR 1360 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
