Dilip Kumar Das @ Babu Das v. State Of West Bengal
06-05-2022 Subha Item no.47 Ct no.34
IN THE HIGH COURT AT CALCUTTA
Criminal Revisional Jurisdiction CRR 793 of 2013 In the matter of : Dilip Kumar Das @ Babu Das & Anr. .....petitioners.
In Re : An application under Section 482 of the Code of Criminal Procedure. Mr. Anwar Hossain Mrs. Sujata Das ................for the State.
The revisional application was preferred challenging the proceedings arising out of Bijpur P.S. Case No. 105 of 2012 dated 02.04.2012 wherein chargesheet was submitted on or about 15th July, 2012 under Sections 286/304A of the Indian Penal Code and Section 11C/12/25/26/11J/11L of West Bengal Fire Services Act. The petitioners approached this court at a stage when the chargesheet was submitted and the Photostat copies of the documents which have been submitted are issues which are to be relied upon at the end of the trial. None of the documents under Section 207 of the Code of Criminal Procedure which forms the basis of the prosecution case have been relied upon.
As none appeared on behalf of the State, Mr. Anwar Hossain, learned advocate who ordinarily appears on behalf of the State was directed to represent the State. His appointment may be regularized by the concerned Authorities in due course.
Having regard to the issues which have been canvassed in this
revisional application which are exclusively question of facts, I am of the opinion that there is no scope for interference by this court. With the aforesaid observations, the present revisional application being CRR 793 of 2013 is dismissed. All pending applications, if any, in connection with the revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
