The present revisional application was preferred challenging the proceedings relating to Bauria Police Station Case No.74 of 2009 dated 01.08.2009 under Section 498(A)/34 of the Indian Penal Code which was then pending before the learned Additional Chief Judicial Magistrate, Uluberia, Howrah. Mr. Dipankar Aditya, learned advocate, appears for the petitioners.
Mr. Arijit Ganguly, learned advocate, appears on behalf of the State and opposes the prayer, which has been advanced by the petitioners.
Having regard to the time which has passed since the revisional application was preferred before this Court and the progress of the case not being part of the record, I am of the view that the present revisional application can be disposed of with liberty being granted to the petitioners to agitate the points canvassed in the revisional application at the appropriate stage of
the proceedings.
With the aforesaid observations, CRR 1301 of 2012 is disposed of.
Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
