The petitioner is in custody for about 15 days and he has been arrested in connection with alleged offences under Section 135(1)(a) of the Electricity Act.

Mr. Aniket Mitra, learned advocate appearing for the WBSEDCL submits that a portion of the assessment of the final bill raised by the Authorities have been deposited by and on behalf of the petitioner. Learned advocate for the State is present.

Having regard to the nature of offence complained of and the purpose for which the petitioner is in custody and as the chargesheet has been submitted in connection with the instant case, I am of the opinion that further detention of the petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner shall be released on bail by furnishing a bond of Rs.10,000/-(Rupees ten thousand only) with two

sureties of like amount each, one of whom must be local, subject to the satisfaction of the learned Judge, Special Court(Electricity Act), Birbhum at Suri.

If on bail, the petitioner shall attend the trial court physically on each and every date fixed by the learned trial court until and unless the trial court is of the opinion that the absence of the petitioner will not be an impediment for the progress of the case. With the aforesaid observations, the present application for bail being CRM(SB) No. 72 of 2023 is disposed of.

All concerned parties shall act in terms of the copy of the order downloaded from the official website of this Court. Urgent Photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities. [Tirthankar Ghosh, J]
